Hello to my cherished clients and friends,

October has always been a month that casts a spell on me, one filled with enchantment and a dash of whimsy. It brings a swirl of memories, especially of my first Halloween after moving from Brazil to the US. Imagine the thrill of discovering the world of glowing jack-o-lanterns, cheeky ghosts, and mysterious witches for the very first time! It felt like stepping into a wondrous fairy tale, one where the lines between the magical and the mundane blurred beautifully.

Beyond the playful spooks and cobwebbed corners, October ushers in a spirit of transformation. The trees don their golden crowns, animals prepare for their winter slumber, and we, too, get wrapped up in this season of change. We find ourselves pulling out comfy sweaters, brewing heartwarming potions, and perhaps, if you're like me, excitedly planning visits to both pumpkin patches and antique vintage markets.

My heart always races a tad faster when I think of a bygone era. Each artifact tells a tale, whispering secrets from a time long past. This month, I’m thrilled to share that I'll be heading to one of my favorite vintage markets, a treasure trove I've been eagerly awaiting! It's a space where history, art, and personal stories intertwine. And, for those of you who share my excitement, here are some of my favorite finds in the photos below.

Drawing from the harvest moon’s symbolism, October is also a powerful time to let go, harvest the “crops” of intentions you have been setting and the work you have been doing since the spring. It is a time for self-reflection, to drop habits, plans or behaviors that aren’t working for you. From this place of contemplation, consider where you would like to put your attention and energy as we move into the new season.

Now, my friends, here’s my challenge to you this month: Embrace October with all its whimsy! Don a witch's hat, dance under the moonlight, laugh with the spirits, and remember, in every cobwebbed corner, there’s a story waiting to inspire. Dive deep into this season, make memories, cherish the transformations, and let the enchanting vibes lift your spirits high!

The True Story Behind "Bad Checks" in Florida

Ever received a check that your bank refused to honor?

Ah, the familiar sinking feeling on seeing those dreaded letters "NSF" or "non-sufficient funds." It's more than just a mere inconvenience; it can have a significant ripple effect on your business operations.

Florida's Legal Stance on "Bad Checks"

Locally, we often term these as "bad checks." And here's something intriguing: Florida law has carved out a specific cause of action for these situations – the Bad Check law. It isn't merely about ensuring the sender rectifies the oversight; there are tangible legal consequences at play.

While I, as a private practice attorney, don't levy criminal charges, it's essential to understand that the State of Florida wields that authority. They can, based on circumstances, take criminal action against the issuer of a bad check.

Drawing upon guidelines from the Florida Attorney General’s Office, the task of prosecuting the crime of passing bad bank checks rests with the State Attorneys across Florida’s 20 Judicial Circuits. Typically, the location where the check was first accepted and processed becomes the grounds for initiating prosecution. However, there's a stipulated legal protocol that the recipient must adhere to for the State Attorney to take action.

On a more personal note, I recall a client's distress when they came to me after a substantial check they received was labeled "bad." This client, a hardworking business owner, was staring at potential financial setbacks. Together, we navigated the nuances of Florida's Bad Check law, ensuring they received the amount due and then some, in penalties. These laws are in place for a reason - to protect and ensure fairness.

Recovering Your Money: Know Your Rights

Now, onto what's likely on your mind most prominently - recovering your money. Plus, covering the attorney’s fees and other costs tied to the process. This is where my expertise, and those of my fellow professionals, comes into play.

Florida's Bad Check Statute (F.S. 68.065) offers a ray of hope. If you've dispatched a written demand for the bad check's amount and haven't been compensated within 30 days, the scales of justice could tilt in your favor. You might be entitled to three times the originally owed amount! Moreover, potential reimbursements for court costs and reasonable attorney’s fees are on the table. And the cherry on top: a service fee of up to 5% depending on the amount of the check.
